Who are AFSA?

If you are looking at applying for bankruptcy at the moment, you might already have come across AFSA, being the Australian Financial Security Authority.

AFSA is a government agency responsible for the administration of the personal insolvency system in Australia.

Di you know that AFSA acts as trustee for about 80% of bankruptcy files in Australia?

Sometimes they are known as the Public Trustee.

AFSA also acts as the system regulator and sometimes takes enforcement actions where they think bankruptcy laws have been broken.

You might be asking yourself why you would speak to Fred Appleton when the government also provides bankruptcy information?

From the many conversations we have had with our clients over the years, the main reasons we have heard for using our bankruptcy services are that:

1. We are specialists at preparing the bankruptcy paperwork and we have been doing this for the last 15 years. In short we take the stress out of ‘making it happen’. You can be assured that all your declarations will be prepared in accordance with the law based on the information you provide us.

2. You have the opportunity to talk to someone who has been there. Fred has been through bankruptcy himself and can help you understand the process of bankruptcy and whether or not bankruptcy is an option you could consider.

3. We can also help you to understand how bankruptcy works from your point of view during a short phone call. We don’t charge for this advice. It is completely free and without obligation.

4. We offer compassionate advice from a family run company with more than 15 years experience of dealing with bankruptcy situations.

5. Although AFSA works as Trustee for the majority of bankruptcies in Australia, if you have a house of other major assets that might be affected by you being bankrupt, it makes sense to establish contact with a registered trustee early on. Similarly if you are a higher income earner, it makes sense to make contact with a trustee to confirm the income contributions you are likely to pay.

Alan Nicholls is someone we have known for many years. Alan is a registered trustee in bankruptcy and is the principal of Nicholls & Co, Chartered Accountants. Nicholls & Co specialise in personal insolvency situations. Alan has written an excellent website that explains, from the Trustee’s perspective, how bankruptcy works.

The Nicholls & co website address is: www. nichollsco.com.au

The contact number for Nicholls & Co is 02 6766 9245.

Nicholls & Co pay for advertising on the two Fred Appleton websites.
