Tony is a successful, self employed business consultant who’s tax affairs had got out of hand.

The end result was that Tony ended up with close to $300k of tax debt he personally owed to the ATO.

It took some time but eventually Tony recognized that his tax debt was unpayable.

Tony has no major assets personally and finances two recent model German cars.

Tony’s has always been a higher income earner and that was not likely to change just because he needed to go into bankruptcy.

Steve Appleton returned Tony’s call same day and they had the first of three or four chats.

During their conversation Steve Appleton made the suggestion that Tony consider making contact with a registered Trustee to have a to have a ‘get to know you’ conversation where Tony could discuss with the Trustee’s how the bankruptcy income contribution system worked.

Tony mentioned to Steve that he had seen a link to Nicholls & Co on the Appleton website and had also seen the Nicholls & Co website during his general research on bankruptcy on the internet.

Tony requested and received the Fred Appleton bankruptcy questionnaires via email during their second conversation.

He completed the questionnaires within an hour or two hour in the following few days and returned them as instructed.

Tony’s bankruptcy documents were prepared to a professional standard by Helen Millward within a few days they were ready for his signature.

Whilst his bankruptcy documents were being prepared Tony spoke with Alan Nicholls who confirmed that Tony was likely to make a contribution from his income and that he could remain a self employed consultant with the preferred business structure being a Sole Trader.

Alan Nicholls went on to tell Tony that if he would like him to act as Trustee and he should send his signed bankruptcy documents to Nicholls & Co and, subject to his review of the ‘Statement of Affairs’ he would consent to act as Tony’s Trustee.

Helen Millward completed Tony’s bankruptcy documents within a few days.

Following some consideration Tony felt comfortable with Alan Nicholls as the Trustee so after he signed and dated his bankruptcy documents he posted them to Nicholls & Co.

After reviewing the Statement of Affairs Alan Nicholls decided to provide consent to act as Tony’s Trustee and he then lodged Tony’s bankruptcy documents with AFSA.

Tony was pleasantly surprised how straightforward the process was.

His bankruptcy was accepted by AFSA about two weeks after his first conversation with Steve.

Tony received his Bankruptcy Notice from AFSA confirming that his bankruptcy application was accepted.

Meanwhile, Tony is back doing what he does best and is going great guns.

Here is what Tony said in an email to Fred and Steve about 9 months after his bankruptcy application was accepted.
